Distance sales agreement
The terms of the contract formed between you and the seller when you place an order.
Parties
Seller: ———, MERSIS ———, address ———, phone ———, email ———.
Buyer: the holder of the name, address and contact details given during the order.
Subject
This agreement sets out the rights and obligations of the parties regarding the sale and delivery of the products ordered electronically through the seller's website.
The name, quantity, sale price and payment method of the products are shown in the order summary and in the order confirmation email.
Delivery
Products are delivered to the address given during the order through a contracted courier. The statutory delivery period is at most thirty days from the formation of the contract.
Items in glass are packed as fragile shipments. If the parcel arrives damaged, having the courier record it makes the claim easier to settle.
For international shipments, customs duty and import charges are paid by the buyer and are not included in the product price.
Right of withdrawal
The buyer may withdraw from the contract within fourteen days of delivery without giving a reason and without penalty. Notice of withdrawal is sent in writing to ———.
Products returned under the right of withdrawal must be unopened and fit for resale. For food products, once the packaging is opened the item cannot be returned for health and hygiene reasons; this limit comes from the regulation.
The refund is paid within fourteen days of the product reaching the seller, using the same payment method.
Disputes
For complaints and objections, the buyer may apply to the consumer arbitration committee or the consumer court in their place of residence, within the monetary limits set by the Ministry of Trade.
This text covers the standard clauses; it needs review by a legal adviser before going live.
